  • H1B awarded for 1 year. What if not landed in USA?

    Hi,
    I have been awarded a H1B visa with validity of only 1 year which expires in Dec-2015.
    What are my options if my company could not send me to US in time?
    Can the visa be extended?

    I am assuming the original I797 also has a date of Expiry of Dec-2015. In that case your current company or any other one wishing to employ you in US has to first file a cap exempt petition, and if that is approved you would get a new I797 with new dates. Using this new I797 you can extend the visa.
