  • H4 Re-Stamping with New Employer

    Dear all,

    I am bit confused about the H4 Re-Stamping for my dependents. I have changed my employer A->B->C and new employer I-797 is approved till May 2017 and stamp(Employer A) on my Visa(02/2015) is expired.

    My dependents (wife and 2 kids) are in India. Wife n 1 kid has previous H4 stamp(Employer A - 02/2015) and one kid has no previous H4 Stamp.

    My wife has travelled to USA last year for 3 weeks.

    Please help me on below questions:

    1.Does my wife need any filing from employer C for H4 like extension etc. since she is out of USA last year itself?
    2.Can they go for stamping with my new I-797 (Employer C)?
    3.My employer has just applied for "PREM" Application(I140 is not yet started) and during visa interview if ask they "Did your husband applied for GC and what should be the right answer ?

    1. No. All you need to do for your spouse and kids is fill up the DS-160 form online, pay the fees, book the fingerprint and visa interview slots, and they attend the H4 interview. Your wife would have to go personally, your kids if less than 14 can use the drop box facility.
    2. Yes, thats what they should go with as you are working with C.
    3. Answer would be NO. If your I140 was applied the answer would be Yes.
