Hi,
I am on H4 visa currently and I had applied for H1b in April 2014.
USCIS approved my H1b visa before 2 days but they denied change of status from H4 to H1b.
They issued I-797B informing to travel out of country, appear for visa interview and enter USA with H1b stamp in-order to change the status to H1b.
If I don't wish to accept this H1b visa, therefore don't travel out of country and stay on H4 visa, then my application is considered approved or denied? Can I use the same EAC number in future to apply for H1b as cap exempt or a have to file a fresh H1b visa following the cap rules and regulations?
Thanks
