  • Travel immediately after H1B Transfer approval but with expired H1B visa

Hi My current I94 expired in Nov , 2014 but i got the H1B extension for my current employer until Nov 2017. Now , my H1B transfer petition is under progress and i want to immediately travel to India briefly before joining my new employer and after quitting my current employer.

    1. I think i will have to go for new stamping since my original visa & I-94 has expired. Do you see any problem here since i will not be in payroll of any of employers and will not have paystub with new employer?

    2. What other documents will i be required during new stamping and at port of entry, apart from petition approval? I will be directly working for new employer for their product development and not for end client.

Thanks in advance. Eagerly waiting for response.

As long as you leave immediately on your last work day with current employer, and go for stamping with new employer's approved petition, and upon successful stamping and entry into US work for the new employer, I dont see any issues.

Make sure you carry enough documentation related to the Product and your role in the project.

Also, avoid travel through Europe as some transit countries require you to have a valid US visa to allow transit through them.

This is my opinion not legal advice.
