H1 Transfer

Hi,

I am working for an Indian company and am here on H1 sponsered by the same company. I want to shift now. If I go back to India, can I resign the company and come back on the same H1 to US and get that H1 transfered here?

Change of status is possible within US if person has maintained lawful status.

You will be taking a chance if you do so. If your employer has decided to cancel/revoke your existing approval, you might not know of it, but hte Immigration Officers at the port of entry will be intimated, you will be in a mess. Better to resign the job while you are in the US, after finding asponsor for transfering the H1B

Urgent: H1b Transfer query--Pls Help

Hi,

I have a similar query.

I am in US currently & planning for a H1b transfer to a new company.How long does it take for H1 B Transfer?
Should I be present in US for the whole duration of H1B transfer ?

Can I go to India meanwhile (once I get the confirmation of H1B transfer) for a vacation & be back on new H1B if it takes a alonger time.
