  • Filing H1B Cap Exempt Case

    Hi Friends,

I had H1B visa from Apr 2012 to Feb 2013 but I did not make use of this, means I did not travel to USA.
Now I am looking to travel to USA by filing H1B cap exempt case.
    1) My case will come under cap exemption category?
    2) how much time will it take to process this case?

    Thanks,
    Suresh

    1. Yes.
    2. If you have an employer ready to process your petition, then 2-4 weeks in premium, if they process it as normal processing 2-4 Months.

This is my opinion not legal advice.

      Thanks for reply.

My employer is not ready to process H1B visa so I am exploring other ways to file H1B cap exemption case for me.
Can you let me know, how to proceed from here? is there any consultancies to sponsor?

      Thanks,
      Suresh

First thing is to find an employer willing to sponsor the H1 petition for you. Do your due diligence before joining a new employer.
