Multiple H1b Transfer. Need Help Urgently.

  • Multiple H1b Transfer. Need Help Urgently.

    I got laid off from Company A in Feb.

    I got an offer from consulting firm B, they filed my H1-b under premium processing and it got approved in March.

    Now, I got another full time offer from Company C, they are also ready to file my H1-b with the paychecks and I797 from Company A.

    I don't want to join Company B and I wish to join Company C.

    1) What are the chances of H1-b Transfer to Company C being approved? As there has been a gap of more than 45 days between my last paycheck and the H1-b being filed.

    2) Company B is asking me to join them asap. But I am afraid to join them because I might not get paid until I get a project. And if I get RFE for H1b transfer of Company C asking for paystubs from Company B I will not be able to provide them.
    What should I do join Company B since H1b is approved but I won't be paid. Or reject there offer and wait for the results of H1b transfer for Company C. Since, Company C is as Full Time offer I don't wish to join Company B.

    3) What is the best option. With Company B I have my H1b approved but will have to wait for long in order to get paid until I find the project. Or Not join Company B at all and wait for another 15 days for decision as they are doing premium processing.

    So you currently are not working anywhere? That would already make you out of status.
    1. Pretty low.
    2. Why would you not get paid? Even if no work you should still get paid by the employer, thats the law.
    3. There is no best option as without pay and work currently you are already out of status.
