I have applied for H1b in 2009 though X company in USA, with has received Date as April 7th 2009, but i never used this H1 or went for stamping. Later in Jan'2011 i came to USA on L1B and working on the same. Now i would like convert from L1b to H1b using the old petition which applied in 2009. My question here is, can i use the same H1b petition which applied in 2009 with CAP Exempt Quota? also what's the importance of received Date (April 7th 2009) in the petition. Please clarify me?
