Hi,
I was in US on L1-B visa and I applied extension in mid 2004 and got approval till mid 2006. In jul 2005 I applied for H1(with COS) through another employer and the H1 petition was approved with same I-94 that was in L1.
I went out of US in Jul05 and got extended L1 visa stamping in india and cameback to US in Nov 2005 with L1. Now can anyone please clarify me on the following:
- Now I have a new I-94 that is different from one that is in H1. So do I need to go out of US and get H1 stamping before converting to H1 ?
- Also since H1 was applied with COS, H1 automatic start date was oct1,2005. But I was not in US in Oct and cameback to US with old L1 in nov'05. Does this affect my H1 in anyway ? Is my current L1 status legal ?
