H1 stamping in new passport

  • H1 stamping in new passport

    I have the following question. If you can answer it would be great help.

    I came to USA on L1 visa in 2007. I have not gone outside USA since then. The L1 visa on my passport expired in 2010.

    My L1 was converted to H1 in 2010 but I did not get any H1 stamping on my passport. I applied for GC in 2010. I have approved i140(approved in 2011) and will apply for extension in January 2016 (797/i94 expiring in January 2016).

    Now my passport is expiring in June 2015. Do I need to get my H1 stamping on the new passport? Is it necessary? If yes how soon I should get H1 stamping on my new passport?

    June 2015 or June 2016? You planning to go out of US in Jan 2016? As without going out of US you cannot get a new stamp in passport.

    Passport extension and visa extension are two different processes. If your passport is expiring in June 2016 , by Jan 2016 as it is you would have a new passport, so the new visa would be stamped in new passport.

    If you passport is expiring in June 2016, you can renew it as early as June 2015, so would recommend you get a new passport before filing for extension.

      My passport is expiring in about 1 month time(June 2015). I am applying for new passport in couple of days. After that I will file for H1 extension. Do I really need to get H1 visa stamping on my new passport after i get an extension if I don't wish to go outside USA.
      In my current passport there is only L1 stamping(which also expired in 2010). Never had any h1 visa stamping on my passport.

        If you not planning to leave US then there is no question of a H1 stamping , the subject of the post is misleading. You technically need not have a visa stamping done if you dont intend to leave US. A Visa is required only for entry into US, whereas an approved extended petition with a valid I-94 is enough to stay and work in US.
