Hi, I filed H4 extension application for my wife when her stamped visa and I-94 expired. Those got expired on Feb 21 2015 and I applied for H4 extension by Feb 15 and got the receipt number before Feb 21 and am still waiting for the approval.
By May 1st, my wife had to go to India and she is now in India. I came to know that I don't need H4 approval if the spouse goes out of USA and she just required my I-797 for stamping. Is it true?
And if that is true, how should I withdraw the H4 application? And If I do, will there be any legal complications when she goes for stamping?
