H1B Transfer RFE due to difference in Company name on H1b Application and Paystubs.

    I thought lawyers are still working on filing your RFE. USCIS would respond back within 15 days from receiving the RFE documents. You should expect a response sometime next week.

      Does it take longer if requested documents may not be provided correctly? Never come across as case like mine, have no idea what they will accept. I am panicking now.

Look up the previous employer's website or google to find any press release about the merger and forward it to your lawyers. If you left the previous employer in good terms, then you can contact them to get a copy of the press release. I feel there is no need in your case to press the panic button. I believe the lawyers know what they are doing and they will handle it right.

        I have a similar issue and am worried a lot as I am planning for Visa Stamping.

        Here is my case: My H1B was approved last year and just last month I noticed that I was receiving paystubs from the sister company. So basically my visa was approved for XYZ.america but paystub has company name as XYZ.us

        Both XYZ.america and XYZ.us have same address but they do have different EIN. My attorney asked the HR to change my payroll immediately to XYZ.america and they did. Now I am receiving paystub from XYZ.america which matches my I-797. But because of this miscommunication, I will be now receiving two W2 for the year 2015.

        Meanwhile I am transferring my H1B to a new company and then planning for Visa Stamping in December. Do you think the Visa Officer will question about the issue of paystubs with my previous company?

        Do you have any advice on how to move forward safely on this matter?

          It depends on how deep the visa officer looks at your case. If they take a look at the W2, then they would figure out. But usually when you attend the visa interview, they pay more attention to the current employer's documents rather than the previous one. So I guess you should be fine.
