H1B Visa Deposit

Hi,

I applied for a visa through this company last year. They asked for a deposit of $6000.00 for it which would be refunded if my wife got her H1B and after being with the company for 1 year or we would get it back immediately if her visa application was not picked up in the lottery process. My wife's application was not picked up in the lottery process. Since then whenever I ask for the refund back they keep making up stories and are yet to refund it. Also, I have all the earlier emails, the image of the check that I gave them and text messages. They do not email back anymore about this.

I am at my wit's end about this. Is there any place that I can file a complaint against this or sue them. Does anyone know the process of going about it? It would be very helpful.

Also, since I am on H1B through a different employer, will this affect my status?

If it is a US entity, definitely get a lawyer involved.

First of all paying to get the H1B sponsorship is illegal. You can definitely get the employer in trouble if you file a complaint with DOL. But at the same time, your wife will also get into trouble for paying money to get the H1B sponsorship.
