H1B Amendment when 221G is in process

Hello,

I have an approved petition and when i gone for VISA stamping, i got 221G asking for client letter and client/employer documents. Unfortunately, my employer did not able to get the client letter as the project is on hold. Now i have opportunity with other client and i want to travel in October 2015. My employer decided to amend my petition for other client and new location.

Now my questions are,

1. Is there any problem amending the petition when 221G is under process ?
2. Do we need to withdraw the existing 221G petition and apply new amended petition or apply the amended petition alone is acceptable ?
3. What could be the chance of approval on amended petition ?
4. What is the processing time of amended petition ?
5. Can we apply premium processing for amended petition ?

>>> No.

2. Do we need to withdraw the existing 221G petition and apply new amended petition or apply the amended petition alone is acceptable ?
>>> If you have not already responsed to 221g and if there is enough time to wait until you can amend the petition, then you can respond back to 221g after the amendment is approved. Other option is to withdraw your visa application and file a new one after your amendment is approved.

3. What could be the chance of approval on amended petition ?
>>> Same as any other petition.

4. What is the processing time of amended petition ?
>>> 2-3 months by normal processing and 15 days by premium.

5. Can we apply premium processing for amended petition ?
>>> Yes.
