H1 visa cap rules

Hi,
I had been approved H1B visa in 2008 and I was working in US under that visa status for 4 months. After that, I have been outside US. If I need to work in US now, do I still have to come under the H1B cap? Do I still need H1B sponsorship?

Hi Priya,

you are eligible for H1B Cap, but ensure that you apply before EOD 2015, You need to find a new employer or your previous employer to file your case for Cab Exemption.
my case is similar one, my I797 was approved in 2007, in 2014 my application was reapplied with the Cab Exemption.
