I94 / H1b Extension Question

My I94 was incorrectly stamped to expire on 1st Sep 2015 even though I had I797 valid till Dec 2016 at POE. Since going to deferred inspection did not work out out company's law firm recommended my employer file H1B extension petition. Is this correct?

I have been on H1b for almost 2.5 yrs now. Is it correct to file H1B extension petition? Shouldnt we be filing I-539 instead? I am just worried that with extension my second cycle of H1B will start kicking in.

Is going to my home country and returning with new visa the only 'safe' solution here?

Was your passport expiring Sep 2015 or your visa expiring in Sep 2015?
