  • L1B to H1B .... Can be done in 2 months ?

    Hi,

    I am working on L1B from past 2.5 years. It is valid till 31st October 2015. I have unavoidable travel to India from 9th October to 13th November. My H1B is already picked and today I got RFE. It will take at least 14 days to get all required documents and send them to Attorney. Now, it seems difficult to get approval before 9th November, since it is just 2 months away. This year, it is running late. If it would have been completed before 9th October, my company could have applied for L1B to H1B change of status.
    I am employed in US branch of my company (4 branches are there in India also), so after 31st October, I will need to off boarded (I am assuming) because, my company know that my visa is till 31st October only. They can not give salary after 31st October. And when I will come back on 13th November and re-join organization.
    As per my situation (I got RFE today), can we know, if process will be completed within 2 months ? I know, it is not possible to predict date, but as per previous experiences, what are chances ?
    Does anybody see any alternate solution/way out for my situation ?
    I will appreciate any help.

    There is a premium processing that will get you the result within 15 days. It is hard to predict if USCIS will take a decision on your case within 2 months or not. This year, they are running late on many applications due the H4 EAD backlog.
