Can H1 be revoked by a VISA office in Indian consulate?

  • Can H1 be revoked by a VISA office in Indian consulate?

    I hold a H1 since 2010, Due to personal reasons I had to come back and work from India in 2012, since then I worked from India(client courtesy)
    Now I am planning to return to USA, recently I have filed H1 with new employer in 2015 and I am planning to go to H1 stamping.
    I also did my W2's for last 2 years.
    In this case can my H1 be revoked?

    Revoking H1B petition has nothing to do with all that you have mentioned in your post. If you no longer work for the employer who filed your H1B petition, they can revoked the petition. Otherwise your petition will remain valid unless revoked by USCIS for some reason (like fraud). What exactly are you trying to ask?

      Thanks for the reply. I am working on H1 but since 2012 I am not in USA. I am in India and working. Is this legal?
      I have file'd tax returns for 2013 and 2014 when i am in India, Is this legal?
