  • Change of Status-h1to F1

I am currently on H1 and want to pursue full time MS. Once I get my I 20 from the university,I will apply for change of status from H1 to F1. When I get I 20, i will quit my job and apply for Cos. the change of status takes a few months but my university allows me to start the classes with the receipt if the approval notice did not come before Jan 2016 when my classes begin.

    My question is:
Since it will take a few months for the approval notice, will I be considered in status or out of status after I quit my job till the approval comes.
Also, how long after applying for COS should I quit my job.

    Please help.

    Thanks.

As long as COS receipt date is before your last day of work, you will not be considered out of status.
This is my opinion and not legal advice.

      Thanks kabkaba.

Can you also tell how long does it take for the COS receipt to come and if you have any idea about the time for the approval notice too.

Receipt notice will come in a week or 2 after you apply (sometimes sooner).

You can check I-539 processing time on USCIS websites. These days especially at Vermont center, they are very slow, taking 8-9 months.
