  • H1 Renewal stamping help

    Hello,
I have question regarding stamping of H1 visa.

    Background:
I came to USA with H1 visa for Employer 1 and client 1A. AFter that i have changed company here and Joined employer 2 for clinet 2A. So i have valid i-797 for employer 2 and clinet 2A. But few months after, my project got changed and now I ma working for different client 2B but its in Same in City as client 2A and my employer is yet to file LCA since my location is same.

    Question:
    1. My current stamping is till 30th Oct 2015 and I ma planning to travel to India on 15th Oct 2015 and returning on 23rd Oct 2015. Do i need to stamp visa before coming back?
    2. Is it mandatory to show clinet letter in for Visa stamping ? since my client in my I-797 is 2A and i ma working for 2B so it would not possible to letter from 2A.

    Will Really appriacte your reply.

    >>> Not required. You can renter as long as the visa is valid. But advisable to get the Visa stamped since your visa will expire soon. For some unknown reason if the officer at the POE issues you the I-94 only till the visa expiry date, then you will be in trouble. But the chances of that happening is very less. Usually I-94 is issued till the petition expiry date as long as the passport remains valid for more than 6 months.

    2. Is it mandatory to show clinet letter in for Visa stamping ?
    >>> If the VO asks for it, then YES.

since my client in my I-797 is 2A and i ma working for 2B so it would not possible to letter from 2A.
    >>> Your employer should have filed the amendment before you joined client B. This can cause issues while you reenter if the officer figures out that you are not working at the location that is authorized by USCIS.

No issues. The name of the employer in the visa stamp doesn't not matter. As long as you have a valid H1B visa in the passport, you can use that to enter U.S irrespective of the employer's name on the stamp.
