  • H1B Transfer without Offer Letter

    Guys,

    I am currently moving from Employer A to Employer B. B is a Bank and will be joining their IT department as Full time employee and guess this will not be under any Client or Contractor Model. The offer has been finalized but the Employer B has confirmed me to roll out the offer letter only after H1B transfer has been accepted by USCIS, however it need not be approved. So they have asked for my H1B documents and will apply for a Transfer - Once receipt is available, they will roll out my offer letter.

    I was not sure if this is a right thing to do since Offer letter might be required for H1B transfer. I do not want the H1B transfer to go into RFE or declined because of the Offer letter issue. Have anyone come across similar scenario in past? Any thoughts around this would be really helpful.

    To mitigate the risks, I would suggest you join the employer only after the H1 petition is approved, rather than joining only on the basis of receipt notice.
