H1 Approved but Rejected in stamping

My H1 visa got approved in 2010, I got i797 with me. But at time of stamping it didn't get through due to lack of project documentation. Do I still eligible for Cap exempt for H1, if I have a new employer?

I got documents list to be submitted

I got documents list to be submitted, I did that but the first project was a federal project and there was no direct letter from client and later on their request my client changed the project . Then they sent me an rejection letter.
