H1b Extn + New H4 Stamping

Hello All,

If anyone come across this scenario, kindly provide your thoughts.

H1b expiring in Feb-2016, I am suppose to start VISA EXTN should be now. Here the question is

1. Once I Start the VISA EXTN now, is there a possibility for me to go INDIA in November ? (Considering I have the VISA Stamping till Feb-2016, but will it have any impact for the VISA EXTN that i am applied ?)

2. In November, what if I want my dependent to go for VISA Stamping (H4) for the current VISA which i have valid till Feb-2016 (considering just 3-4 months valid). Will embassy approve H4 ?

You are suppose to leave the country when your extension is pending. If you leave your EOS will get denied. Either file the extension in premium, get the result and then travel or come back and file the extension. Your family can apply for H4 as long as your H1B petition is valid. But it is advisable to go for H4 stamping with an extended petition. So if possible, file the extension in premium and then go for stamping together.
