H1 approved in 2012 but expired, can I file under cap exempt

Hi everyone
My H1 got approved and stamped in 2012 But I never travelled to USA on H1.Can I now apply under cap exempt, if so what will be the validity, will it be six years from now I.e. 2021 or only the remainder three years I can use till 2018, if I apply this year in 2015.
