  • H1 B Reinstatement

    In India company A filed my H1B visa which got approved and also my stamping for h1b was done in January 2015 which is valid till 2017. Later, I resigned in June from company A and H1B was not used.Then applied for H4 Visa and came to USA on H4 VISA which is valid till 2017. Now in USA I was contacted by employer B who is ready to get my H1 B reinstated and eventually I will get the job in US.

    My questions are below :

    1. If I go to India after my H1B reinstatement, Do I need to go for H1 B stamping again?
    2. Do I need to file change of status as well?
    3. If in future I again go for H4 from H1B and then travel to India then do I need to go for stamping again?

    >>> In order to return back in H1B status, you need a valid H1B visa stamped in your passport and it should be valid as of the date of your return. Do you have a valid H1B visa in your passport. If so, you can use that to return back and there is no need to go for stamping. But if my assumption is right, your H1B visa in the passport shuld have been cancelled when you applied for H4 visa.

    2. Do I need to file change of status as well?
    You will need to file a COS from H4 to H1B only if you enter U.S in H4 visa. If you enter U.S in H4 visa, you cannot work until the COS gets approved.

    3. If in future I again go for H4 from H1B and then travel to India then do I need to go for stamping again?
    >>> It depends on what status you are planning to return back. To come back in H1B status and begin working immediately, you need a valid H1B visa. To return back in H4 status and be a dependent, you will need a valid H4 visa. If you enter in H1B visa, you should be working and getting paid to maintain the H1B status or you will go out of status on H1B. If you enter in H4, you should not work until a COS is filed and it gets approved. So it all totally depends on what you want to do.
