My wife's H-1B petition has been approved, but the transfer from her current H4 status to H1 has been denied by the USCIS. It was suggested that she travel to India to get her H1 visa stamped before she starts working.
We are making plans for travel in the months of Oct-Nov 2015, but I have some questions regarding her current status. The H4 visa currently stamped in her passport is the one sponsored by my previous employer. I have changed jobs recently, and she has a new H4 from my new employer. Both these petitions are still valid (old till Dec 2015, new till Dec 2016).
Here are my questions:
1) Will the absence of the new H4 stap in her passport affect the H1 stamping in any way?
2) In the case that her H1 stamping does not go through, will she still be able to travel back to the US on the currently stamped H4 visa from my previous employer? Or will she have to get the new H4 stamped in order to travel?
