Withdrawing L2 after approval

Hi,

My spouse employer have filed for my L2 extension. And I have H1b approved which is going to be effective from 1st Oct. Probably L2 will get approved in Nov or Dec and then I will be back to L2 status, because of the last action rule.
Can the attorney withdraw L2 after is it approved, so that I will be back on H1b or
filing change of status is the only option?
