security check on H1B extension via employer A. can I go for H1B Transfer ??

Hi My employer A has filed my H1B extension in Premium Processing. And it got stuck into "Security check". My I 94 is expiring on 30 sept. Can I file another petition through employer B as "H1B Transfer"?

Any suggestion thoughts ??

Possible. But it will have to be a bridging petition. Employer B's petition will get approved only if employer A's petition gets approved. Search and read about "bridging".

Its not necessary. My case is not falling under bridge petition. If employer B can get approval early, I can start working with him. This is what attorney told.

If the transfer is filed after your I-94 expiry date based on a pending petition then it is called bridge petition.
If employer B's petition gets approved with a new I-94, then you can certainly work for them.

My petition got approved today. MY old employer's h11b petition is still on HOLD due to security check.
and FYI -- this security check is for employer related.

Company transfer is the only option during security check.
