  • interview waiver program for H1-B with Consular filing

    Hi All,
    I badly need some help. I finished my project sometime back at previous client and got a new project recently with a different client.
    my employer filed an LCA with the new client, but by the time we have the approved LCA I will be out of status.
    So, they want to file the H1 with consular filing and I have to go to India for Visa stamping.

    Can you please help me on the following

    1. Am I eligible for Interview waiver program(drop box). my previous H1 stamping is from India.
    I did not change employer, basically my employer and my visa category are the same. Hopefully this should be my last (4th) H1 before I get my EAD.

    2. Do I really need to go to India or Can I apply for my visa interview in Mexico or Canada ?

        You will be eligible for dropbox because there is no question there that asks about your H1B status. However, while filing the DS160. you need to mention that you have accumulated illegal stay (Not out of status) if you stay past your I-94 expiry date. In such case, the VO can call you for an in-person interview.
