  • Student visa option after being on H1-B

    Hi,

I have worked in the US on an H1-B visa from October 2010 to March 2014. From April 2014, I have been working in India. I am now considering applying for a student visa in the US and taking up some courses (I'm thinking of continuing education options and not a degree program for one or two years). Can I apply for this student visa now? Also, once I am in the US can I take up job interviews and have an employer apply for a cap-exempt H1-B visa? (I still have two and a half years left on my 6 year H1-B period).

I would greatly appreciate any input on my student visa options after being on H1-B for some time in the US.

    Thanks in advance!

Technically yes, but didn't understand "continuing education options and not a degree program for one or two years". What is "continuing education options" ? For F1 visa, a suitable intent to study along with self funding for the same has to be proven. Visa officer's are well aware of this route to get entry to US without having a job, but no actual intention to study, so you might have to rethink your strategy.

This is my opinion not legal advice.
