  • H1B amendment and Dependents travel

    Hi,

I am currently at USA with H1B visa. My employer has filed an amendment for Chicago location. I have currently moved to Chicago (date of filing 01-Oct-2015). I have not yet received the Receipt Notice for Amendment filed. My Wife has H4 visa stamped on the Receipt No for my previous location(Erie). Can she travel to Chicago with the initial receipt no, copy of petition and LCA? Or do she need to wait for the receipt no for the Amendment filed?

She can travel. But it is better if she travels with a copy of the H1B amendment receipt so that she has proof if the officers questions her on choosing Chicago as the POE.
Not a legal advice. Use of this information is strictly at your own risk.

      Thanks for quick response.
What if she says she will travel from Chicago to Erie, as the feasible ticket was for Chicago.
My initial petition is for Erie Location.

Kindly let me know if this will work with Immigration Officer at POE.

Do not unnecessarily complicate the situation by giving any false information. Rather than giving false information, she can tell that the amendment has already been filed for the new location with USCIS and you are waiting for the receipt notice. In the mean time, if you receive the receipt notice, scan it and email it to her and ask her to carry it. Even without that, she would be good to travel.
