Hi Team,

Need a suggestion on my situation. I am currently in US on L1 B from July 2015, I have applied for H1 B new visa in April 2015 and my petition is picked in the lottery and approved. I wanted to quit my current company and join the H1 B employer now without going back to my home country for visa stamping. Can I do the Change of Status from L1B to H1B? Is this legal?

I have learnt from my employer that I am not eligible for the transfer as I was not in US while applying for new H1B in April 2015. Please advise.

Yes, the employer can file a change of status from L1 to H1B and when the COS gets approved, you can begin working for the H1B sponsor.
