H1B Cap Exempt Petition

Hi,

I had H1B visa with validity till 2017 but never traveled to US with it. Then i quit my job and came to US on H4. My H1b was revoked by my employer when i quit my job. My questions are:

1) will i be cap exempt if i apply for h1b again. (kindly note that i had never been on US on h1b status)
2) if i am cap exempt, can i file h1b again at any time of the year.

Kindly help me with your advice. Thanks in advance.

When was the petition filed? Do you have the I797 Approval notice with you?

Hi,
The petition was filed in April 2014. It was valid from october 2014 to jun 2017. However it was revoked in August 2015. I submitted the original I797 approval notice to employer when i quit my job. But i have a scanned copy of it.
