H1-B Cap Exemption

Hi All,

My H1-B was revoked prior to October 1ST (have not used the VISA) My new employer is willing to sponsor a new visa now am I cap exempt in this case? and hen can my employer file for the visa?

Which year your petition got approved ? Ask the new employer to confirm with attorney is the best idea.

Is the petition filed this year under a brand new CAP. If Yes, then withdrawing the petition prior to Oct 1st will make you out of CAP. Meaning, you are no longer CAP counted. A transfer is not possible in such case.
