Is it ok to travel out of US while H4 EAD is under process?

Hi All,

I am planning to apply for H4 EAD for my spouse based on my I140 (once I get approval).

But we want to visit India also during same time.

Is it possible to visit India after applying for H4EAD and its under process? Or will it impact processing of H4 EAD?

Nope. The person need to be in U.S while H4 EAD is applied and should stay in U.S during the processing time. EAD cannot be applied to someone who is not in a valid H4 status (Whe you spouse leaves the country, she is no longer in H4 status). Best option is return back from your vacation and then file the H4 EAD.
