Change of Employer after October and COS deined

Hi all,

I am in a strange situation, please help me. Currently I am working for company A under CPT. And I have approved H1 from company B, but COS is denied. I got approval on OCT 30 and 797B came with a request to go to India for stamping and change of status. Employer from company A is asking me to transfer H1 so that I can get client letter and also I can show Work experience to VC, ..etc. Can anyone tell me whether it is a good idea to apply for transfer with COS denied? I want to know if that even possible to transfer employer with denied COS ?

Yep, possible. If your new employers documents are in order, the transfer will get approved. The CAP from the approved petition can be used to file the COS.
