  • H1 Visa Situation

    Hi,

I changed from employer A to Employer B recently (June 2015).

I have Employer A's Visa in my passport which is valid till Feb 9th 2016. I have to go to India for an emergency and should be back by Nov 30th.

My visa extension with employer B is also approved.

Do I have to get extended VISA stamped in my passport when I enter the country by end of this month?

Since I will be back in two weeks, I am not sure if I would have time to go for VISA stamping. Hence the question.

    Thanks.

You can use the previous valid H1B visa to re-enter. By showing the new approval, usually you should get an I-94 matching the expiry of that approval notice. But some officers tend to issue a I-94 matching the visa expiry date. If that happens, then you will have to file the extension again before that I-94 expires even if the previous petition is valid for a long time.
Not a legal advice. Use of this information is strictly at your own risk.
