Hi,

My H1 got expired in 2010 and I797 also expired in 2010. I have heard that I can reapply for H1 under cap exempt till 2016. One of my friend told me that after expiration of I797 we are under exempt till 2016. Is that correct? If my previous employer cancel my I797 then also can I apply.

Yes, H1B CAP is valid for 6 years. Petition can be transferred even if it is withdrawn or expired.
