  • H1B transfer I94 endorsement on passport

Hi All I have received my H1B transfer approval notice today but my attorney suggested the following

Please note that H1B approval of YYYY does't have I94 and he/she needs to contact nearest consulate to get I94 endorsement on the passport. The beneficiary is not allowed to work in the USA till he/she get new I94. For endorsement he/she may submit original approval notice along with the enclosed supporting documents at the Consulate.

    What it mean?
    1. Do I need to go out of USA for stamping?
    2. If not 1, do I need to submit all my documents to consulate? If so consulate in USA or Home country

    Thanks in advance

    >>> Yes. If you already have valid H1B visa in the passport, then you can leave the country and return back using the new employer's approval notice and old valid H1B visa in the passport which will get you a new I-94 associated with your new employer. If you use the old visa, then it is possible that your I-94 can be issued only till the visa expiry date.

    2. If not 1, do I need to submit all my documents to consulate? If so consulate in USA or Home country
    >>> There won't be a U.S consulate inside U.S. A consulate for a country will be in other countries, and not inside the same country.
