  • Clock Reset

    Hello,

    1. Stayed in USA on L1 from Jan 2011 to Oct 2011
    2. Oct 2011 to April 2013 was in Banglore for more than 1 Year
    3. Came back to USA in May 2013 on same L1 before its expiry
    4. Got L1 extension after coming back to USA valid from Aug 2013 to Aug 2015
    5. Got H1B lottery in 2014 and due to Consular processing did not start on H1 in Oct 2014, went back to India in Aug 2015 to get H1b stamped
    6. Came back from Banglore and started on H1 from Sept 2015

    Please tell me if the clock is reset for me and I have 6 Years?

    Nope. In order for the clock to reset, you should have stayed out of U.S for 1 whole year and then file a new H1B that is subjected to a brand new CAP. That doesn't seem to be the case here.

      @Shervin,

      Thanks for replying. As I mentioned I was outside of US for more than a Year and my H1 is in lottery (Dont you think its a brand new CAP)?

        Was your H1B filed while you were outside U.S after spending 365 days outside U.S? I thought your H1B was filed while you were on L1 status in U.S.
