Hello All,
My name is Sai krishna and I am from India. Currently I am in the US on H1b visa since November 30, 2015 along with my wife for a 2 year assignment. We are expecting our first baby and the delivery would happen in the US. Since, the baby is delivered in the US, he/she would acquire US citizenship by birth. My question is, my project is only for 2 years with my company and i need to return back to India after 2 years. So in that case what would happen to my child US citizenship. Also, I have heard that if the child is US citizen, the child should be bought to the US regularly to make sure we comply to the US law of the safeguard of their citizens.
Can anyone help me understand the US laws and immigration rules on what would be the right approach in my case. As of now i have not yet decided to transfer my H1 to another company as if i leave my current company i need to pay then a repayment fees of all the relocation they have spent on me.
Kindly help so that i can take a right decision.
