  • Visa Expired - Eligible for H1b Transfer Or Extension

    Dear Friends,

Can you please provide some guidance here? Appreciate your help!

I got my H1B approved Nov 2012 and had visa stamped in the year Jul 2014. my Visa validity is from Nov -2012 to Sep 2015 but got stamped 2014 . I was travelled to US and worked for 6 months (Aug 2014 - Jan 2015).Due to personal reasons came back to india after that i am not able to go back to us.My Visa period is expired and my employer doesn't extended my visa petition and i don't know the exact information, whether they have hold it or withdraw my petition or not.

I would like to join another company with my same visa , Is my visa is eligible for Extension/H1b Transfer or
Do i need to apply for new h1b visa. In case of h1b transfer to company b , Do i need to go visa interview again.

    Please advice.

    Thanks in advance ,
    Regards,
    Nisha

Any U.S employer can file a H1B transfer for you as long as you have a copy of the previous H1B approval notice. You don't need to go through quota again. You need a valid H1B visa stamped in the passport to travel to U.S. So when the H1B transfer gets approved, you need to go for stamping. Once visa gets approved, you can travel to U.S to work for the H1B sponsor.
