Applying H4 EAD for spouse but with only 5 years of stay in USA on H1B

I have a valid H1B visa. I'm planning to apply H4 EAD for my spouse. However My 6 year period was supposed to end in May 2017. But with my approved labor my attorney got it extended till May 2018. I also have an approved I140. This is my 5th year in USA on H1B. So is my spouse eligible to apply H4 EAD?

If you have an approved I-140, then your spouse is eligible to apply H4 EAD.
