L1 to H1B Consular Visa Confusion
Hello ,
I need your help in understanding the possibilities moving on to H1B visa while being on L1 in US.
I am on L1 Visa and applied for H1B in April 2015.
I visited India in July on personal work and came back to US in a week after my petition is picked in the lottery.
Recently I could find my H1B case is approved and I came to know from my Consultancy that my H1B is approved but I cannot work for them as it is a consular visa. My I94 has changed with my India visit and it is not the same when I applied for H1B. They asked me to travel back to India for a week, get H1B stamped and come back to US to work with them.
1) I would like to know if there is any way to switch on to H1B with out going to India.
2) Is there any way to update my I94 and get eligible to work on H1B
3) Currently I was told that my change of status would not get affected. I am still on L1 and can work on L1 as long as i do not go for H1B Visa Stamping. I did not quite understand what the change of status means and how would it affect.
4) How about my dependents . I have not included them when filing H1. They are currently on L2 Visa. If I go alone to India for H1B stamping leaving them in US , how would it affect their L2 Visa .
5) Can I apply for their H4 visa after coming back to US on H1B.
6) Does the time frame I worked on L1 get counted for my tenure on H1B
I might have asked you numerous questions, but I am not sure how to proceed ahead.
Ignore H1B and continue on L1 or go ahead and try for H1B.
