Non-Capped H1B to Capped H1B

Hi All,

My current H1 visa is from a non-profit organization(University) and I got an offer from a private company which agrees to do my H1. I understand that new H1 will come under cap for which processing starts from April. I have few queries regarding that.

1. My current H1 (non capped) is filed for extension(still pending), will there be any problem if we file a new H1 under cap? Will there be a bridge application?

2. If my new H1 picked up in lottery , can i still work in my present job till October and then from October start working for the private company?

3. Will my present H1 be affected by the outcome or the processing of the new H1? like in case if new H1 not picked up or not processed?

1. No dont think so. But the Capped H1 may not come with new I-94 unless the current non capped H1 is approved.
2. Yes, and October is the earliest you can start on it.
3. Dont think so.
