Scenario: My H1 renwal(filed on Nov 1 2015) is in RFE(Premium Processing) and Feb3 2016 was the last date to submit and attorney did not submit RFE docs and have sent a mail to USCIS for an extension for filing RFE documents on Feb 9th and my current I797 and I94 expired on Nov 11 2015. Is it legal for me to stay in USA. Is it legal to work now until we hear from USCIS about denial?
