H4 to H1B VISA from USA but Issue in the H4 Visa validity
Hi,
I am on H4 dependent visa, Currently in Houston, Tx, USA. I'm in touch with a few of the consultancies and they are ready to file for my H1B petition for year 2016- 2017. I can chose any one from these to proceed ahead on this. But the issue (which I think in my case) is my Visa validity of H4 which is till 08th September 2016. If everything goes positive and I'm getting picked in the lottery in the visa process, what can happen?
1. Will there be any query asking about my stay in USA from 8th September 2016 to 30th September 2016? (Because I'll be able to work from 1st October 2016 on H1B visa and I may have to leave the country before 8th September 2016 if H1B visa extension result is not coming till then)
2. Will the H1B Visa still gets approved and USCIS will ask me to leave the country and come back again with the Visa Stamp of H1B from my home country?
3. Or anything else which I may need to take care here in this case?
4. My spouse is filing for the H1B extension on 9th March 2016, do we have to leave the country if the extension result does not turn up before 8th of September 2016 or we can stay till the result of extension comes?
5. What should be the best step from my end in this case to move forward?
Any help on this will be highly appreciated.
