  • I 140 Receipt number received Change Employer

    Hello Everyone

    Apologies if this has been discussed earlier..

    My I 140 was received by USCIS on February 16, 2016. I got my receipt number.. I got a better job offer and would like to move.

    1. What would be the impact on the I 140 process for me. Would I have to start all over or can the I 140 be transferred?
    2. If the I 140 is not transferred can my old employer still hold onto the I 140 and wait till its gets approved ?

    Please let me know any options available..

    1. It would have to be refiled if you wish to work for the new employer on a permanent basis in future. I140 cannot be transferred, only priority dates can be retained under certain circumstances.
    2. Yes, if they are willing to.
