New H1B Cap Petition Filing when Old H1B Petition is not used

Hi,

I had filed for a H1B Capped petition in 2009 and had got the approval. But I havent travelled or got the Visa Stamped due to some constraints.
Now another employer wants to new H1B Cap Petition. I have not disclosed the old Petition to the new employer.

Questions -
1 - Are there any chances that the new Petition will get rejected as the Old Petition is not used and only 5 years have passed?
2 - Are there any chances the the new employer will come to know about the old Petition?
