  • H1B - Off CAP filing

    Hi All,

    I had a H1B visa from Oct 2013-Sep 2015.
At the time of filing the visa, the visa was filed for client A. But for some reasons, i could not go ahead and work for client A.

A few months later, there was a requirement at client B.

My company then did a LCA transmittal and i travelled to US in June 2014 to work with client B.

Due to personal reasons, i had to return back to India in August 2015 and let the visa expire.

Now, there is a requirement with client B again and i'm required to travel to Client B's location (exact same location)

How long will it take for an out of cap H1 to be approved by normal processing and premium processing? Is there a chance it may have an RFE? The client wants me on-site within 2 months. Is it enough when filed through premium processing?

    Thanks.
